Acceptance of the Terms of Use

The company with the corporate name "INKJIN PRIVATE COMPANY," headquartered in the Municipality of Chalandri, Attica (332 Kifisias Avenue), with Tax ID 803292939, Tax Office KEFODE Attikis, and General Commercial Registry No. 193959701000, with electronic contact address support@inkjin.com, (hereinafter "the Company") operates the Website inkjin.com ("Website") and the mobile application Inkjin ("Application" or "Inkjin") and the online services provided through them, together with any information or material contained therein (e.g. photographs, text, graphics) (hereinafter "the Material"), for the purpose of enabling Inkjin's users to create an account, search for tattoo designs ("Designs") created and submitted by tattoo artists included in the Application ("Artists"), virtually preview designs on their body using Augmented Reality ("AR") technology, and communicate with Artists who work with the Application.

The terms and conditions below apply to the use of the services provided by the Application. Any user who simply visits our Website or Application (hereinafter a "Visitor") may register electronically and use the services offered by our Application either as a registered user searching for tattoo designs (hereinafter, for brevity, a "User") or as a tattoo artist who has created a profile on our Application (hereinafter, for brevity, an "Artist"). Every Visitor who visits our Website, and every User and Artist who registers on the Application, is deemed to consent to and unconditionally accept the terms below, included in this document, without exception. If a Visitor/User/Artist does not agree with one or more of these Terms of Use, they must, at their own responsibility, refrain from visiting or using the Application, as well as from using any of the Application's services.

Accessing the Website or Application in any way, and using the Application's services, constitutes unconditional acceptance of the Terms of Use, as in force at any given time. The Company reserves the right to freely modify or revise the Terms of Use whenever it deems necessary, and undertakes to notify of any change by renewing these Terms of Use. Aside from the renewal of these Terms of Use on the Website and the Application, no further notification of Visitors/Users/Artists is required for the renewed Terms of Use to take effect. For this reason, the Company encourages all Visitors/Users/Artists to visit this page periodically to stay informed of the current Terms of Use.

Inkjin's Online Services

a) Creating an Artist Profile

Inkjin is an Application through which Artists can inform Users about their professional profile, the tattoo Designs they have already created, the dimensions offered for each Design, the estimated time to complete each Design based on its size, and the estimated price. To create a profile on the Application, an artist must have at least 2 years of professional experience providing tattoo services, work at a recognized/reputable tattoo studio, have a portfolio of original creations in the styles they specialize in, and comply with the health and insurance legislation applicable in their country for the provision of tattoo services. Once an artist meets the above criteria, they may complete the relevant online Artist registration form, available at the following link: https://bookpay.inkjin.com. The Company will then review all of the artist's information, approve their registration, and contact them to finalize the artist's inclusion on the Application as an Artist. A prerequisite for the Artist's inclusion is their acceptance of the Terms of Use and their being informed of the Company's Privacy Policy.

b) Creating a User Profile and Searching for Designs and Artists

Similarly, Visitors may install the Application on their devices, register as Users, and search for available Designs and Artist profiles, as well as find out the size, cost, and estimated completion time of each Design from the Artist.

When creating a profile, Users are asked to submit their information via the relevant online User registration form, accepting the Terms of Use and the Privacy Policy. Use of Inkjin's online services is permitted exclusively to adults over eighteen (18) years of age, or to minors who have obtained the necessary consent from their parent(s) or legal guardian(s). By accepting the Terms of Use, the User or Artist declares that they are an adult over 18 years of age or, if under 18, that they have obtained the necessary consent from their parent(s) or legal guardian(s) and will provide their information if requested.

When a User creates an account on the Application, they confirm that the information they provide is accurate, complete, and up to date at all times. A User may not create an account using someone else's information, provide an email address that does not belong to them, or create fake or multiple accounts.

Once Users find a Design they are interested in, they can save it as a "Favorite" by clicking the "Like" button, in order to find it easily on the Application later.

c) Use of Augmented Reality Technology

When a User finds a Design they like, they can use Augmented Reality (AR Kit) technology to explore how that Design would look on their body. This feature of the Application is called "Try On" and allows the Design to be displayed directly on the User's skin, offering a realistic preview from every angle, by pointing the User's device camera at a spot on their body that has been marked with a marker. Once the Application detects the marked spot, the selected Design will appear in real time on the User's skin, without the image being stored. The User can move the Design on their body, change the Design's size, and rotate it to see how it looks from different angles and lighting.

In addition, if the User wishes, they can use their device's camera to take a photo of the Design displayed on their body and save it to the "My Tattoos" collection, to view later or share with friends.

Using the same technology, Inkjin also allows Users to upload their own tattoo designs and try them on their body.

d) Use of the AI Tattoo Price Estimator

Inkjin allows Users to use the Tattoo Price Estimator, a feature that provides tattoo price estimates based on designs uploaded by the User. The estimate is based on similar designs and pricing data from professional artists in Inkjin's database. To use this service, the User must upload to the Application a photo of a tattoo they are interested in, in order to receive a cost estimate with a price range derived from AI analysis of the image. It is noted that the cost estimate provided by this service is indicative only and in no way constitutes a guarantee of the actual cost of a tattoo. The Artist may set the tattoo's price differently from the estimate provided by this feature of the Application. For this reason, Inkjin recommends that Users contact the Artist through Inkjin to obtain a personalized quote. In any event, Inkjin bears no liability for any monetary discrepancy between the cost estimate provided by the Tattoo Price Estimator and the actual price set by the Artist, nor for any decisions made by the User based on the cost estimate provided by this Service.

e) Hardy – AI Tattoo Consultation Assistant

Inkjin provides Users with access to Hardy, a conversational assistant powered by artificial intelligence, designed to help Users clarify what kind of tattoo they want before contacting an Artist.

It is expressly clarified that Hardy is not a tattoo design generation tool, a booking system, or a browsing service for Artists or Designs. Hardy's sole purpose is to help the User form a clearer picture of their preferences (style, size, placement, cost) before communicating with an Artist through the Application.

Hardy does not impersonate, represent, or act on behalf of any specific Artist. The information, suggestions, or estimates provided by Hardy are informational and supportive in nature and do not, under any circumstances, replace direct communication, advice, or agreement with the Artist, who alone is responsible for the final design, cost, and execution of the tattoo.

Hardy does not provide medical advice. Any information Hardy may provide regarding allergies, skin conditions, aftercare, or other health-related matters is for informational purposes only and does not replace the advice of a doctor or other qualified healthcare professional. The User should consult the Artist and, where deemed necessary, a doctor, before proceeding with a tattoo.

The User acknowledges that Hardy is an artificial intelligence system and may, in certain cases, produce inaccurate, incomplete, or outdated responses. Inkjin does not guarantee the accuracy, completeness, or suitability of Hardy's responses and bears no liability for decisions made by the User based solely on them.

Use of Hardy is prohibited for: (a) attempting to extract, disclose, or reproduce its internal instructions (system prompts) or operating logic, (b) attempting to manipulate its behavior through malicious instructions (prompt injection), (c) sending content that is unlawful, offensive, or contrary to these Terms of Use, and (d) any use beyond the consultative support purpose for which it is designed.

The User's conversations with Hardy are subject to the Company's Privacy Policy.

f) Communication with Artists

Inkjin allows Users to communicate directly with Artists regarding the tattoo services they provide. Specifically, Users can follow the Artists they choose in order to stay informed about Artists' new Designs. In addition, Users can send a personal message and photo to the Artist of their choice through Inkjin, either to discuss any changes they want to a Design and its price, or to book an appointment with the Artist for a tattoo. Using the messaging feature, the User can also cancel an already-scheduled appointment with the Artist.

g) Booking Appointments with Artists

After selecting a Design, the User can book an appointment with the Artist by selecting "Book this Design" on the Application. The User is then asked to complete the Booking Form, providing information determined by the specific Artist, such as: the tattoo placement, a photo of the desired placement, and any other information the Artist deems necessary. The User then selects a date for the tattoo service from the Artist's available slots, and a payment method. Once payment is completed, the appointment booking is automatically confirmed, and the User receives an email with the date and time of any required consultation session with the Artist, the date and time of the tattoo appointment, proof of payment, and preparation instructions from the Artist.

If the User wants changes to an available Design (size, colors, other details), the User must follow the process for a personalized tattoo by selecting "I want to make changes" on the Artist's Design within the Application. The User then specifies the desired changes to style, size, and placement, uploading any photos they wish. After the Artist reviews the requested changes, the Artist informs the User of the completion time for the tattoo, the total cost, and the deposit amount required to confirm the appointment. If the Artist determines that a consultation session with the User is required, the booking of that session and the tattoo appointment take place together in the next step.

Payments

a) Deposit

Once the User decides to receive tattoo services after discussing the design, cost, and any other matters with the Artist through Inkjin, as well as the appointment date and time, the User is asked to make a payment through Inkjin using a secure payment method. The User may choose to pay either only a deposit, paying the remaining balance directly to the Artist on the day of the tattoo, or the full payment, paying the entire amount in advance.

b) Booking Fee to Inkjin

In every case, a booking fee of 10 euros is added to the total amount the User is required to pay, which is paid directly to Inkjin and not to the Artist. The User is not charged any other fee by Inkjin beyond this. Inkjin is obligated to remit the deposit amount to the Artist, after deducting the above booking fee that it withholds.

c) Payment Method

All payments are made securely through Stripe, the world's leading payments platform. Inkjin does not add any additional commission for payment via Stripe. Inkjin reserves the right to change payment provider at any time, notifying Users through these Terms of Use.

d) Payment Information

Through Inkjin, the User will have access to all payment details, including the total cost, the deposit amount, and the payment method, before confirming the booking with the Artist.

e) Inkjin's Liability for Payment

Inkjin's liability is limited to providing secure payment methods through the Application. Inkjin bears no liability for any disputes or problems arising from payments made outside the Application, such as payments made directly to the Artist.

Cancellations & Rescheduling of Appointments – Refunds

a) Cancellations

Each Artist working with Inkjin sets their own cancellation deadline (e.g. 24 hours, 48 hours, or 72 hours before the scheduled appointment). The User is informed by Inkjin of the cancellation deadline set by each Artist. If the User cancels before the cancellation deadline, they are entitled to a full refund of amounts paid, both for the Artist and for Inkjin. If the User cancels after the cancellation deadline, the deposit paid through Inkjin is not refunded, while the booking fee — Inkjin's fee — is refunded to the User. If the Artist cancels the appointment, the User receives a full refund of all amounts paid, including the deposit.

Inkjin acts as an intermediary booking services provider and bears no liability for cancellation policies set by each Artist.

b) Rescheduling Appointments

Each Artist also sets their own rescheduling policy, which may include limits (e.g. once, twice, unlimited, or not at all).

If the User reschedules within the limit permitted by the Artist's policy and before the cancellation deadline, the booking is transferred to the new date at no additional charge to the User. If a rescheduling attempt is made after the cancellation deadline, or exceeds the permitted number of changes, the action is treated as a cancellation, and the Artist's cancellation policy applies.

If the Artist needs to reschedule the appointment, they inform the User, who is then given the option to select a new date.

c) Refunds

Refunds are made in accordance with the following:

(i) Where the User has paid only a deposit, it is refunded in full provided the cancellation occurs before the cancellation deadline set by the Artist. If the cancellation occurs after the Artist's cancellation deadline, the deposit is not refunded.

(ii) Where the User has paid in full in advance, it is refunded in full where the cancellation occurs before the Artist's cancellation deadline. If the cancellation occurs after the Artist's cancellation deadline, the deposit amount is retained by the Artist and the remaining amount is refunded to the User.

(iii) The booking fee — Inkjin's fee — is always refunded in the event of a cancellation, regardless of whether the Artist's cancellation deadline has passed, and regardless of whether the Artist refunds the User or not.

All refunds are processed via Stripe or whichever payment provider Inkjin uses at the time, within a reasonable period.

d) No-Show

If the User does not show up for their appointment with the Artist, the deposit they have paid is retained by the Artist as compensation for the time reserved, while any remaining amount already paid by the User is refunded to them.

e) Rationale for the Deposit

Deposits are requested and paid in order to protect the Artist's time and availability. Inkjin makes every effort to keep the booking and cancellation process transparent, fair, and secure for all Users and Artists.

f) Inkjin's Role

Inkjin has not entered into any form of employment relationship or partnership with the artists it hosts on the Application, and it does not resell or act as a third party's representative in any way. Inkjin provides the Application to Users and Artists entirely free of charge and facilitates communication between them through the Application.

Liability

a) Liability of Visitors and Users

Every Visitor, Artist, and User is deemed solely responsible for accessing their personal accounts on Inkjin, as well as for controlling, using, managing, and safeguarding their passwords on our Application.

Every Visitor, Artist, and User agrees and undertakes to use the services provided by Inkjin in accordance with the law, on the basis of good faith and fair dealing, and in accordance with these Terms of Use.

Visitors, Artists, and Users of Inkjin must provide the information requested of them correctly and accurately. Information provided/completed by the User to fulfill their request is considered confidential and is transmitted only to the Artist to whom it must be transmitted in order to provide the specific requested Inkjin services. This information may be transmitted to any competent authority or authorities as provided by law, where requested by such authorities or where the User's use is contrary to these Inkjin Terms of Use and/or applicable Greek legislation in general.

Every Visitor, Artist, and User is responsible for their use of Inkjin and may use its services only for lawful and legitimate purposes. By way of example and not limitation, it is prohibited to:

a) misuse Inkjin's services by the User or Artist in scheduling or finalizing an appointment which the User or Artist does not intend to keep,

b) create fake accounts with fraudulent intent,

c) cause damage to Inkjin's servers or networks or to the software's source code,

d) create obstacles to the smooth and lawful use of the Application by other Users,

e) install, promote, or transmit digital viruses and/or dangerous/harmful files or programs through the Application,

f) send unsolicited electronic messages (spam),

g) infringe the rights or personality of third parties,

h) unlawfully collect and generally process personal data of other Visitors or Users for any unlawful or unfair purpose,

i) use the Application for any unlawful purpose or to promote unlawful activities.

The use of any method of monitoring the Application, or of copying part or all of its operating mechanism or content, is not permitted. In particular, the use of any program or other method of interfering with the Application's operating mechanism, or any action that burdens or misuses its technological infrastructure, is prohibited.

Inkjin reserves the right to temporarily or permanently prohibit the use of its services to any Visitor, User, or Artist who, in Inkjin's absolute judgment, does not comply with these Terms of Use or applicable legislation. Where use of the Application's services has been suspended or prohibited for a User, re-registration or use of the Application's services is not permitted without Inkjin's prior written consent.

b) Inkjin's Liability

Inkjin makes every effort to provide accurate, complete, valid, reliable, and up-to-date information through this Website. In all cases, however, Visitors, Artists, and Users acknowledge and accept that, given the nature and evolution of Inkjin's products and services, as well as the nature and technical demands of the internet, Inkjin may not be able to maintain, at every moment, full control over all content and the security of the Website and the services provided.

Although Inkjin will make every effort to protect the Website from digital viruses and/or dangerous or harmful destructive files, it cannot guarantee that the Website will never be affected by such files. In any event, responsibility for safeguarding each Visitor's, User's, and Artist's equipment and software systems is limited exclusively to their own diligence, and Inkjin will bear no such liability.

Inkjin undertakes to promptly make every effort to correct any inaccuracies in content, errors, technical defects, and weaknesses, whether identified by Inkjin or reported by a third party or even a user of our Website's services. Nevertheless, each Visitor, Artist, and User uses any information and material available and contained on our Website entirely at their own risk. In any case, Inkjin reserves the right to discontinue operation of all or part of the Website for maintenance or upgrade purposes, or for any other reason the Company deems appropriate. Inkjin does not, under any circumstances, guarantee the accuracy, completeness, or availability of the Application, its content, pages, services, options, or their results.

c) Limitation of Inkjin's Liability

Inkjin does not determine, and consequently bears no liability for, the tattoo methods followed by the Artist with whom the User's appointment has been arranged. Furthermore, Inkjin bears no civil liability for acts or omissions of the Artist relating to the practice of their profession or any unlawful act or omission thereof. Under no circumstances does Inkjin provide guarantees regarding the quality of tattoo services offered by Artists at their premises, and it will not be liable in the event of any dispute or problem arising between Artist and User. The inclusion of an Artist on Inkjin does not constitute, and should not be regarded as, an endorsement or approval of the quality, level of service, qualifications, or rating of any Artist or the services they provide.

As noted above, the pricing of tattoo services provided is determined exclusively by Artists. Consequently, Inkjin bears no liability for the pricing of tattoo services set by the Artist. Any dispute or disagreement between User and Artist regarding a financial transaction taking place outside the Application must be resolved without Inkjin's involvement.

Each Artist must ensure that the appointment takes place in a suitable location where the Artist is lawfully entitled to receive their clients and that all legally required conditions are met.

Furthermore, with respect to use of our Website and Application, Inkjin bears no liability, to the extent permitted by law, for any direct, indirect, moral, consequential, or other damage arising from or connected with the use of the Website or Application, including, indicatively, the inadvertent download of computer viruses from the website or from emails sent from it.

Inkjin does not, under any circumstances, guarantee the accuracy, completeness, or availability of the Application, its content, pages, services, options, or their results.

Inkjin provides the Application and makes every reasonable effort for its continuous and proper operation and maintenance. Users and Artists agree that Inkjin will bear no liability for the interruption of operation or improper functioning of the Application. In the event of malfunction or temporary unavailability of the Application, Inkjin will make every effort to restore its operation, and will bear no liability for the period until proper functioning of the Application is restored.

Content

The Company will monitor content and reserves the right to remove — in whole or in part — content that, in its sole judgment, violates applicable law, these Terms of Use, or may harm the Application's reputation.

The Visitor, Artist, and User of the Website/Application must not use our Website and Application to send, post, or otherwise transmit content that is unlawful for any reason, causes unlawful injury or damage to the Company or any third party, or infringes the confidentiality or privacy of any natural person. By way of example and not limitation, it is prohibited to send, post, display, or transmit through Inkjin content: a) for which no right of transmission exists under law, b) which infringes any patent, trademark, trade secret, copyright, or other third-party rights, c) which contains software viruses or any other code, files, or programs designed to interrupt, damage, destroy, or limit the functioning of any software or computer hardware, d) which constitutes harassment of third parties in any way, e) that is false, threatening, untrue, misleading, offensive, harassing, defamatory, vulgar, immoral, scandalous, pornographic, or blasphemous, and f) content that could exploit or otherwise harm minors, or that violates or supports the violation of Greek or European legislation.

Inkjin reserves the right to temporarily or permanently prohibit the use of its services to any Visitor, User, or Artist who, in Inkjin's absolute judgment, does not comply with these Terms of Use or applicable legislation. Among other things, Inkjin may exercise this right in cases involving the use of abusive or offensive language by the User or Artist. Where use of the Application's services has been suspended or prohibited for a User, re-registration or use of the Application's services is not permitted without Inkjin's prior written consent.

Artists' Designs depicting nudity or erotic content are permitted without censorship. However, the following are not permitted and will be immediately removed from the Application:

(i) Designs depicting behavior that could lead to violence, such as non-consensual or violent sexual acts.

(ii) Designs depicting fetish content involving acts likely to lead to the death of a person or animal, dismemberment, cannibalism, or bestiality.

(iii) Designs containing defamatory comments, or that promote religious, sexist, homophobic, racial, or racist hatred, or engage in other forms of discrimination.

If you become aware that content has been posted on the Application that you consider to violate applicable law, these Terms of Use, or any of your rights or the rights of a third party (including intellectual property rights), please contact us immediately at support@inkjin.com.

Upon receipt of a complaint, Inkjin reserves the right to request verification of your identity and to seek further information in order to verify the content of your complaint. Pending full investigation of the complaint, Inkjin may take actions, including removal of content and measures against repeat violations. Full investigation of the complaint includes forwarding the complaint to the parties involved so that they may present their views on its content.

Any false, misleading, or inaccurate information may give rise to civil and criminal liability for the violating party.

Links on the Inkjin Website

Inkjin includes links to websites of third-party providers, businesses, etc. It is understood that these linked websites are not under Inkjin's control, and Inkjin bears no liability for the contents of any such website or any link contained on a linked website, or for any changes or updates to such websites. Use of the links is not mandatory for the Visitor, Artist, or User, and the fact that they are provided through Inkjin does not imply that the Company endorses or accepts their content. Use of third-party websites is at the Visitors'/Users'/Artists' own risk and is subject to the terms of use of those websites, while full liability (civil and criminal) for the security, lawfulness, and validity of the content of such websites rests with the owners and/or administrators of those pages. If the Visitor/User/Artist connects to such sites, they alone bear the risk of that connection and access, without any involvement of Inkjin.

Inkjin's Intellectual Property

All content on our Website, including trade names, marks, images, graphics, photographs, designs, text, etc., constitutes the intellectual property of our Company or of third parties for which our Company has obtained a license to use on its Website. In addition, the intellectual property rights in the Application — i.e. the software required and used by the Application, and the intellectual property rights relating to its appearance and functionality, including the Application's infrastructure, as well as ratings — belong to Inkjin. The intellectual property of our Company and of third parties is protected under the relevant provisions of Greek, EU, and international law for the protection of intellectual and industrial property. Accordingly, any copying, transfer, or creation of derivative works based on this content, or misleading the public regarding the actual administrator of our Website, is prohibited. Reproduction, republication, uploading, communication, distribution, or transmission, or any other use of the content of our Website or Application, by any means or method, for commercial or other purposes, is permitted only with the prior written consent of the Company or the rightsholder of the intellectual property. The Visitor/User of the Website and Application understands and accepts that they are not granted the right to reproduce, copy, sell, resell, process, and/or commercially exploit, in any way, all or part of the content of Inkjin's Website and Application.

It is noted that the Designs displayed on the Application constitute the intellectual property of each Artist hosted on the Application and are used under license. Accordingly, it is prohibited to sell, copy, modify, reproduce, or republish the Designs displayed by an Artist on the Application. An exception applies to photographs using Augmented Reality technology, i.e. photographs displaying a Design at a location on your body. You may use these photographs solely for personal use, provided you have not removed the indication of their Inkjin origin. Any commercial use of these photographs is expressly prohibited.

The information and Designs available on our Application are provided by the artists, who bear full liability for the accuracy and correctness of this information. When you communicate with an Artist, make a booking, or purchase a tattoo service, you enter into a legally binding agreement with them.

Privacy Policy

For any matter concerning the processing of personal data of our Visitors/Users/Artists, please refer to the Application's/Website's Privacy Policy, available on both the Application and our Website. The Privacy Policy constitutes a single and inseparable part of these Terms of Use.

Amendment / Violation of the Terms of Use

Inkjin reserves the right to modify the Terms of Use and any other rule governing use of the Website at its absolute discretion, notifying each modification on the Website and the Application each time. The Terms of Use will state the date of their last update. Inkjin encourages Visitors, Artists, and Users to periodically review the Terms of Use to stay informed of their content and any changes. In any event, Inkjin reserves the right to change these Terms of Use without prior notice.

Inkjin undertakes to oversee the application of these Terms of Use at its absolute discretion. If Inkjin identifies a violation of these Terms of Use by one or more Visitors, Artists, and/or Users, they will be liable to compensate Inkjin for any positive and/or consequential damage suffered as a result of that violation.

Governing Law

The above terms and conditions for use of the Application, as well as any amendment, change, or alteration thereof, are governed by applicable Greek law and the law of the European Union. If any part of the Terms of Use becomes contrary to applicable law, it shall automatically cease to be effective and be removed from this document, without in any way affecting the validity of the remaining Terms of Use.

In any event, any dispute arising from the application of these Terms of Use between Inkjin and Visitors, Artists, or Users shall be governed by Greek law. The courts of Athens with subject-matter jurisdiction shall have exclusive jurisdiction over any disputes arising from the application of these Terms of Use.
